A FHVC is a registered trademark owned by the company FHVC – FUTURE HEALTHCARE, VIRTUAL CLINIC, UNIPESSOAL, LDA. (hereinafter referred to as FHVC), with NIPC 516037170, which is part of the Future Healthcare Group, whose mission is to provide its customers with access to the best health, life, and well-being conditions.
This document aims to introduce the principles of personal data protection and processing followed by FHVC under Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, the General Data Protection Regulation (hereinafter GDPR), as well as other legislation regarding privacy and personal data in force at any given time.
The protection of personal data is a commitment of all companies belonging to the Future Healthcare Group (FH Group) towards its Clients. We recommend carefully reading this document, as well as consulting the Terms and Conditions of our services and products.

DATA PROTECTION OFFICER
The entity responsible for collecting and processing your personal data is FHVC – FUTURE HEALTHCARE, VIRTUAL CLINIC, UNIPESSOAL, LDA., with NIPC 516037170, headquartered at Avenida Marechal Craveiro Lopes nº 6, 6ª, 1700 – 284 Lisbon.
However, some processing activities may be carried out by other FH Group entities, acting as Subprocessors, particularly regarding billing processes and customer support services.
FHVC has appointed a Data Protection Officer (DPO) whose mission is to:
Inform and advise the Data Controller, subcontractors, and all company employees who process personal data;
Monitor compliance of data processing with applicable standards;
Establish contact with the Client to clarify any questions regarding the processing of their personal data;
Cooperate with the supervisory authority.

DATA COLLECTION
The data collected by FHVC is adequate for its activity, relevant, and limited to the purposes intended, namely for providing the health services contracted by the Data Subjects.
Your personal data may be collected through various means: in person, by telephone, email, or through forms such as creating an account in the customer area.

DATA CATEGORIES
FHVC has access to two types of data when providing its services: personal data and health data.
Personal data can be defined as information relating to an identified or identifiable natural person, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, electronic identifiers, or one or more elements specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
Health data refers to personal data relating to the physical or mental health of a natural person, including the provision of healthcare services, which reveal information about their health status.
Some of the personal data we request are mandatory, without which it will not be possible to provide the product and/or service. In such cases, you will always be informed of this obligation as the Data Subject.

During the subscription process of a service or acquisition of a product, including the scheduling of medical acts; through the creation of a personal account in the customer area; when you contact our services and/or are contacted by them; when you file a complaint and during its handling. -
Data related to the subscribed product/service (Card number)
During the eligibility process; -
Health Data (data relating to diseases, health conditions, and medical history)

Your comments and/or messages on our Social Media
When you voluntarily share your personal data using your profile on FHVC’s social media; -
Your comments and/or messages in our satisfaction surveys
When you voluntarily and deliberately respond to satisfaction surveys sent by our services. -
Browsing data
Through cookie collection when accessing and browsing our websites. -
Image and voice
Normally, during telemedicine services, no voice or image is recorded. Whenever such recording occurs, the client must expressly consent to it;

DATA PROCESSING
When we process your personal data, which may fall under one of the categories listed above, we do so in full compliance with the data protection rules in force.
We only process your personal data for specific purposes and based on a lawful legal ground.

Management of pre-contractual and contractual relationships, including quality assessment of services provided – i.e., when data processing is necessary for the conclusion, execution, and management of the contract entered into with FHVC;

As FHVC is a healthcare service provider, it naturally processes special categories of personal data—health data—which are legally justified by the provision of medical services.
We also inform that we may process health data for scientific research purposes. In such cases, the data will always be anonymized, and prior information and consent will be obtained from the client.
4.1 Call Recording
Whenever you contact us, and with your consent, we may record calls for managing pre-contractual and contractual relationships, namely as proof of contracted services, transmitted information, service improvement, and quality control. Whenever call recording occurs, recordings will be kept in compliance with determinations from the National Data Protection Commission and applicable legislation.

DATA RETENTION PERIOD
FHVC keeps your personal data for as long as necessary to fulfill the purposes for which they were collected, or until you exercise your right to object, right to erasure, or withdraw your consent where applicable. Once the purpose for which the data was collected ends, FHVC reserves the right to retain your personal data exclusively to comply with legal obligations and whenever necessary to guarantee rights in legal, administrative, or tax actions.

DATA PROCESSING SECURITY
FHVC applies all appropriate technical and organizational measures to protect and secure personal data, ensuring confidentiality, integrity, availability, and resilience of processing systems, as well as timely access to data in the event of physical or technical incidents. To ensure processing security, in addition to pseudonymization and encryption of personal data, we have processes to regularly test, assess, and evaluate the effectiveness of technical and organizational measures.

DATA TRANSFER
During its activity, FHVC may disclose your personal data to other entities, such as FH Group companies, for billing and customer support purposes, acting as subprocessors.
The use of service providers and suppliers by FHVC is established through specific contractual agreements, subject to all measures and obligations resulting from the GDPR, ensuring that subcontracted entities provide sufficient guarantees for personal data processing with respect for the rights of data subjects.
Personal data processing by FHVC occurs within the European Union. Whenever there is a need to transfer data outside the European Economic Area, such transfer will only occur if adequate safeguards and respect for data subjects’ rights are ensured, in compliance with the GDPR and applicable legislation.
Notwithstanding the above, this website uses Google Analytics, and therefore your personal data may be transferred to the United States of America. The User may disable this function at any time through cookie management.

RIGHTS OF THE DATA SUBJECT
FHVC’s DPO is responsible for ensuring communication with Data Subjects and for establishing contact with the National Data Protection Commission. Data Subjects are granted the following rights:

Right of Access
The Data Subject may access their personal data and request information about which personal data is being processed by the Data Controller. -
Right to Erasure
The Data Subject may request the deletion of their data without undue delay whenever:
i) the data is no longer necessary for the purpose for which it was collected;
ii) the Data Subject withdraws consent;
iii) the data has been unlawfully processed;
iv) the data must be erased to comply with a legal obligation. -
Right to Rectification and data updating
The Data Subject has the right to have incorrect, outdated, and/or incomplete data corrected and/or updated by the Data Controller. -
Right to Data Portability
The Data Subject has the right to obtain the personal data they have shared with the Data Controller or have it transmitted directly between controllers when technically feasible. This right can only be exercised when processing is based on the Data Subject’s consent, contractual obligations, or in cases of automated processing. -
Right to Restriction of Processing
In certain circumstances, the Data Subject may request the restriction of processing by the Data Controller. -
Right to Object
The Data Subject may object to the processing of their data unless the Data Controller has legitimate grounds that override the Data Subject’s interests or for judicial purposes. -
Right not to be subject to automated decisions
The Data Subject has the right not to be subject to decisions made solely through automated means, without human intervention, when such decisions significantly affect them, except where legally provided. -
Right to Lodge a Complaint
The Data Subject may lodge a complaint with the Data Controller and/or the National Data Protection Commission www.cnpd.pt
When the basis for lawful processing is consent, the Data Subject may withdraw consent at any time. Withdrawal does not compromise the lawfulness of prior processing but may affect future service provision.
FHVC has created specific procedures to ensure the exercise of these rights. In some cases, additional information may be requested to confirm your identity.
The exercise of rights by Data Subjects must be done through the appropriate form or sent via the channels indicated in the “CONTACTS” section of this policy.
